PUBLIC CONTRACT (offer)
for the order, sale and delivery of goods
This contract is the seller’s official and public offer to enter into a contract of sale of the Goods presented on the globecore.com website. This contract is public, i.e. in accordance with Article 633 of the Civil Code of Ukraine, its terms are the same for all Buyers regardless of status (natural person, juridical person, individual entrepreneur). In full agreement with this contract, the Buyer accepts the conditions and the procedure for placing an order, payment for the goods, delivery of the goods, return of the goods, liability for a an unscrupulous order and all other terms of the contract.
This contract is an agreement between Private Company GlobeCore (“GlobeCore” online store) (hereinafter – the “Seller”) and any juridical person, individual entrepreneur or natural person or a user of the services of the online store, hereinafter referred to as the “Buyer” (hereinafter – the “Buyer”) which includes all the essential conditions of the organization of the buying and selling remotely.
- General Terms
1.1 The following information is the official proposal (offer) of the GlobeCore online store to any person (hereinafter referred to as the Buyer) to enter into a contract for the sale of goods. The contract is public, i.e., under article 633 of the Ukrainian Civil Code, its terms are the same for all Buyers.
1.2. In accordance with article 642 of the Ukrainian Civil Code, placing and confirming an order is a full and unconditional acceptance of the terms of the proposal (offer), which confirms the conclusion of the contract for the sale of the goods under the following conditions.
1.3. By concluding the Contract (i.e., accepting the terms of this Proposal (Offer) by placing an Order), the Buyer confirms the following:
The Buyer is fully aware of and agrees with the terms of this proposal (offer);
It authorizes the collection, processing and transmission of personal data under the conditions set out below for the collection, processing and transmission of personal data. Permission to process personal data is valid for the entire term of the Contract, as well as for an unlimited period after its termination.
- SUBJECT OF THE CONTRACT
2.1 The seller undertakes to transfer ownership of the goods to the Buyer and the Buyer undertakes to pay and take delivery of the goods under the terms of this Contract.
2.2 . This agreement regulates the purchase and sale in the online store, including:
– voluntary selection of goods by the Buyer in the online store;
– placing an order in the online store by the Buyer;
– placing an order by the Buyer by telephonic communications or e-mail;
– payment for an order made in the online store, made by the Buyer;
– execution and delivery of the order to the Buyer under the terms of this Contract.
2.3. The date of concluding the Offer Agreement (acceptance of the offer) and the moment of full and unconditional acceptance by the Buyer of the terms of the Contract is the date of filling in the order form located on the website of the online store, provided that the Buyer receives an electronic confirmation of the order from the Seller. The Contract may be concluded in writing at the request of the Buyer if necessary.
- Product Information
3.1. The product, which is presented in the catalogue of the online store via a photo sample, is an original product.
3.2. Each photo sample is accompanied by text information: name, item, price, description and technical characteristics.
3.3. The price indicated on the website of the online store may be changed by the Seller unilaterally.
- Placing an order
4.1. The Buyer places an order in the online store through the “Cart” form, or by ordering by e-mail or telephone specified in the contacts section of the online store.
4.2. The order conditions are reflected in the “Ordering” section of the online store.
4.3. The Buyer is responsible for the accuracy of the information provided in the Order.
- Price and Delivery
5.1. Price, payment conditions, delivery and payments between the Seller and the Buyer for the Goods are specified on the website of the online store in the “Payment and Delivery” section.
- Return of the Goods
6.1. The Buyer is entitled to return to the Seller the non-food items of proper quality, if the goods did not satisfy him in form, dimensions and size, or if the Goods cannot be used for its intended purpose for other reasons under the applicable law.
6.2. The return of the goods in the cases provided for by the law and this Contract is carried out at the address specified on the site in the “Contacts” section.
- Confidentiality and protection of personal data
7.1. By providing their personal data on the website of the online store when registering or placing an Order, the Buyer gives the Seller their voluntary consent to the processing, use (including transmission) and other actions regarding their personal data, provided by the Law of Ukraine «On the Protection of Personal Data», without limitation of the validity of such consent.
- Other conditions
8.1. The present agreement is concluded in the territory of Ukraine and operates in accordance with the current legislation of Ukraine.
8.2. The Seller has the right to modify this Contract unilaterally as provided for in clause 3.3 of the Contract. In addition, amendments to the Contract may also be made by mutual agreement of the Parties in the manner prescribed by the current legislation of Ukraine.
